CONDITIONS OF CONTRACTING THE SERVICE AND ACCESS TO THE FESTENTS AREA
Below are the general conditions of sale of the accommodation service for rent in pre-
assembled tents and other types of accommodation, as well as access to the premises of the
FesTents ZONE (hereinafter, "Glamping Zone"), for each of the events or festivals in which this
area is enabled and for which said service is specifically contracted.
The organizer of the Glamping Zone is the company EMIRVAR, S.L. (hereinafter "FesTents")
with address for these purposes at C / Divina Pastora, 7 de Burriana, C.I.F.: ESB16897415,
registered on 1/06/2012 in the Mercantile Registry of Barcelona, Volume 43208, Folio 140,
Inscription 1 with sheet 426958. Contact email: hola@FesTents.com
The mere acquisition of the tent or other type of accommodation or invitation for
accommodation in the Glamping Zone, in any of its modalities, entails the automatic and
unconditional acceptance of the following general conditions relating to the sale of the service
accommodation for rent in pre-assembled tents and other types of accommodation shops and
access to the Glamping Zone (hereinafter, "General Conditions"):
1.- BOOKING CONDITIONS
1.1.- The reservation of one of our tents or other accommodation gives the right to the use
and enjoyment of them and their goods, in accordance with the conditions of opening and
closing of the Glamping area that appears in the confirmation email.
1.2.- The payment made is by tent or type of accommodation (goods included). The payment
of the price of the store or other accommodation will be made in a single payment, made at
once, regardless of the number of occupants who will have access to it, and that can never
exceed the maximum number of people established on the FesTents website for each type of
tent.
1.3.- The price for the use and enjoyment of the tent or Accommodation includes only the
goods and services referred to in the description thereof established on the FesTents website for each of the festivals or events.
1.4.- The payment that will be made, will be only for the use and enjoyment of the Store or
Accommodation and Goods, not conferring the holder of the reservation or the occupants of
the accommodation, in any case, any right of acquisition over them.
1.5.- The occupants of the Store or Accommodation must vacate and abandon them, as well as
deliver all their Goods, on the day and at the time established in the confirmation email of the
reservation and, in any case, before the closure of the Glamping Zone.
1.6.- All Goods made available to the occupants of the tent or Accommodation will be kept
during use with due diligence, avoiding causing damage or deterioration in them beyond those
of their normal use. All occupants of the Tent or Accommodation being jointly and severally
liable together with the holder of the reservation for any damage caused to them.
1.7.- The choice of the location of the Store will be the decision of FesTents, according to its
own criteria.
1.8.- The holder of the reservation must pay a deposit of FORTY EUROS (40 Euros) to cover possible damages that may occur, committing himself to pay the difference in the event that,
produced these, had a cost higher than the amount of the deposit deposited. The charge will
be made on the same card on which the deposit has been charged, after verbally informing the
holder of the reservation, or failing that, the occupants if in the case that the holder is not an
occupant.
If the tent or accommodation is seriously damaged, the holder of the reservation will pay for
its repair or replacement in full, an amount not fully covered with the € 40 deposit.
1.9.- The price of the reservation does not include the daily cleaning of the interior of the
tents, nor the changes of bed linen. In case the client is interested in obtaining these services,
he must make a request paying the cost of the services at that same time.
1.10.- FesTents is not responsible, in any case, for the objects left in the tents or
Accommodation or in the Area adjacent to them, although the Glamping Zone is equipped
with fenced space and security to watch over objects and people.
2.- E-MAIL CONFIRMATION OF RESERVATION AND ACCESS TO THE GLAMPING AREA
It is important to read well the content of the e-mail confirming the reservation of the
accommodation and the rights, obligations and services that it incorporates, since, after its
acquisition, they cannot be changed, except as stipulated in clause 5 and section 5 of clause 2.
2.1.- The confirmation email of the reservation of the accommodation is configured as a
nominal title, for whose configuration, during the purchase the personal data of the client will
be requested that will be registered in our Customer Database to keep them informed of the
contracted service and promote our services.
2.2.- The reservation confirmation e-mail includes an order number that identifies the
reservation. Glamping is not responsible for this identifier or reservation code being used by a
person other than the one that appears in the document as a buyer and / or that it is falsified,
duplicated or photocopied.
2.3.- After receiving the confirmation e-mail, the link to check in at the booked
accommodation will be sent, also via e-mail. This check in, once filled in with all the data of the
occupants, day and time of arrival at the Glamping Zone, must be printed and shown at the
Glamping Zone Reception, along with a valid identity document (ID, Passport ...). This
document will be required of each of the occupants of the accommodation that appear on the
check in sheet.
2.4.- The reservation will only be valid when it has been acquired through the FesTents
platform (FesTents.com), through the platform of the festival or event in question, or in any of
the detailed points of sale and / or authorized distribution channels as detailed on the
FesTents website (FesTents.com).
2.5.- The reservation of the accommodation will always be for all the days of the festival or the
event for which it has been reserved. The booking confirmation e-mail will show the opening
and closing period of the Glamping Zone, taking into account that: The schedules detailed in
this point may be modified by Glamping if necessary, being duly communicated the new
schedules on the FesTents website, through a communication via mail or through any of the
communication channels of FesTents.
2.6.- Specific characteristics of the reservation of accommodation with access to the Glamping
area.
1. Access to the Glamping Zone is reserved exclusively for those attending the Festival or Event
for which it has been booked. In order to access it, it is necessary to have the ticket of the
Festival or the Event in addition to having purchased the accommodation on the platform:
https://FesTents.com or in the authorized sales channels.
2. In some cases, whenever the Festival or Event requires it on its website, for access to the
Glamping Zone a Camping Supplement or an Access to the Camping or Rest Area will be
required. This requirement will be determined for each of the cases and will appear both on
the Festival website and on the theglamping.com.
2.7- Cancellation policy for reservations or orders:
1. The buyer may exercise his right of withdrawal for a maximum period of 14 calendar
days, counting from the date of acquisition of the order or from the date on which the
reservation was made, provided that it had been made, at least, 30 calendar days
before the start date of the event.
2. Once this period has elapsed, the amount of the order cannot be returned, being the
acquisition of the same firm and unconditional.
3. To make effective their right of withdrawal, the buyer, within the period indicated,
must send a registered letter or reliable document to FesTents to the address
indicated in these Conditions, or mail to hola@FesTents.com, confirming their desire
to exercise the present right of withdrawal, as well as accompanying receipt or proof
of the reservation made, stating exactly the date on which it was made.
2.8.- To enjoy its full effectiveness and the rights incorporated, the check in document must be
complete and in adequate conditions.
2.9.- The check in document has different security measures that guarantee its authenticity.
2.10.- The organization is not responsible for reservations or orders that have not been
purchased at official points of sale.
2.11.- Any amended check in document, or with indications of falsification or alteration will
enable FesTents to deprive its bearer of access to the Camping Area, without prejudice to the
right to take appropriate legal measures against the allegedcounterfeiter or counterfeiters of
the tickets.
2.12.- The reservation of the accommodation does not entitle its owner or third parties to use
it, or its content, for advertising, marketing or promotional purposes (including, but not limited
to, contests, gifts and / or raffles), associated with the holder of the ticket or third party.
Failure to comply with this point will oblige the advertiser and / or unauthorized user to
compensate the organization with the amount of the damages caused.
2.13.- FesTents will deliver invitation passes -called Passes- to those people who freely decides.
3.- WITHDRAWAL OF THE RESERVATION AND EXCHANGE FOR THE BRACELET
3.1.- The reservation must be exchanged for a wristband on arrival at the Glamping Zone at the
FesTents Reception and the assignment of the store to the first occupant who checks in. The
reception of FesTents is open 24 hours from the moment of opening of the Glamping Zone
until the moment of its closure (dates and times that appear in the e-mail confirmation of the
reservation).
3.2.- Once this reservation has been exchanged for the bracelet at the reception of FesTents,
the bracelet becomes the element that certifies the right of access and stay and must be kept
on the wrist during all the days of the Festival or the Event.
3.3.- The loss of the bracelet will mean the loss of the right of entry and / or permanence in the
Glamping area and, therefore, the reserved accommodation.
3.4.- The organization warns that open, manipulated, damaged or broken bracelets will not be
accepted.
3.5.- To temporarily leave the Glamping Zone and to enter again, it will be necessary to keep
the bracelet during all the days of the Festival or the Event.
3.6.- Only people who appear correctly on the check in sheet can redeem the bracelet. When a
reservation is going to be exchanged by several people or occupants, all of them, jointly, must
show it along with their IDs or passports at the reception of the Glamping Zone.
3.7.- In case of access of minors to the Glamping Zone, in addition to the above requirements,
the specifications of the right of admission of minors determined by the organization of the
Festival or Event in question must be followed on its own website.
4.- SUSPENSION OR CANCELLATION OF THE FESTIVAL OR EVENT FOR WHICH FesTents has been
reserved AND CASES OF "NO SHOW" DUE TO FORCE MAJEURE BY THE CLIENT
4.1.- The suspension, cancellation or modification of the Festival will not result in the refund of
the amount of the accommodation reservation, when it occurs once the Festival or Event has started and that the cancellation, suspension or modification in question is due to force
majeure.
4.2.- The cancellation, total or partial, of the Festival or the Event due to climatic contingencies
due to rain or other adverse weather episodes will not imply the refund of the amount of the
accommodation reservation.
4.3.- In order to guarantee the client his reservation, in the event that the Festival is canceled
due to force majeure, FesTents will proceed, upon request by the client within the established
period and duly informed on the FesTents website itself, to refund the amount of the
reservation or offer the client a reservation equivalent to the original reservation for a new
date established by the organizer of the Festival or Event or for the next edition of the Festival
or event, or even for another event managed by FesTents.
4.4.-In case of "no show" by the customer in the Glamping Zone, due to impossibility of
assistance due to justified force majeure, FesTents applies the same guarantee as in point 4.3
4.5.- Notwithstanding the foregoing, FesTents, in the event of cancellation, suspension or
modification of the Festival or the Event, in no case will assume costs that are the
responsibility of the attendee, such as travel expenses, transportation, food or drink, among
others.
4.6.-In relation to the return processes caused by the cancellation or change of dates due to
COVID-19, in an extraordinary way, we adhere to the return deadlines set by the festivals, with
the aim of offering a longer period to those customers who wish to send us any request. This
request must be sent directly to Emirvar, S.L. by the holder of the reservation
5.- CHANGE OF OWNERSHIP OF THE TICKET
5.1.- The holder of the reservation can not be modified, since the payment of the same is
associated with it, but you can transfer your tent to third parties by entering their data in the
check in sheet. In the event that this sheet is already filled with the owner's data, the latter
must write an email (from the email left at the time of booking) to Glamping
(hola@FesTents.com) requesting such a change. Once the new check in document is
generated, the third parties to whom the accommodation has been transferred will be able to
access the Glamping Zone and enjoy the reserved accommodation.
5.2.- This change of name of the occupants of the tent or accommodation can never be
requested or made if the physical check in has already been made in the Glamping Zone.
6. RIGHT OF ADMISSION
6.1.- FesTents reserves the right of admission to the Glamping Zone.
6.2.- FesTents complies with the regulations for access and permanence of minors to the
Glamping Zone that each Festival or Event establishes in its camping regulations included on
the event website. In any case, the consumption of alcohol and tobacco to minors under 18
years of age is prohibited, and the minor may be expelled, and companion where appropriate,
who violates these prohibitions, without this generating any right to refund the amount of the
ticket paid by the minor and, in the case of minors under 16 years of age, of your companion.
6.3.- For access to the Glamping Zone, the public may be registered at the entrance, not
allowing the introduction of objects that may be considered dangerous by the organization of
the Festival or Event (included in the camping regulations) or by FesTents itself, or are
prohibited by current regulations.
6.4.- For security reasons, access to any type of motor vehicle is prohibited in the Glamping
Zone.
6.5.- FesTents may deny access or expel from the premises those persons who: (i) may cause
or have caused situations of risk, danger, fights, disturbances or similar behaviors; (ii) may
hinder or have hindered the normal development of coexistence in the Glamping Zone (iii)
carry drugs or are at the discretion of the organization in states of apparent or potential
intoxication; and, in any case, (iv) carry any object that the organization considers dangerous in
the environment of the Glamping Zone (pyrotechnics, weapons, bottles, glass objects, laser
pointers, etc.,...); or (v) do not follow the instructions issued at all times by FesTents, those
established in these General Conditions and / or in the Camping Regulations of the Festival or
Event.
6.6.- Glamping in none of the above cases will refund the amount paid to those people who
have been denied access or who are expelled from any of the Festival venues.
